Terms of Service

1. Who you are contracting with

These Terms of Service ("Terms") are entered into between you and 431 Real Estate Solutions("we", "us", "our"), the provider of this website and the 431 Property Evaluator (the "Service").

2. Acceptance

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

3. The Service

The 431 Property Evaluator provides tools to help you evaluate real estate opportunities. Outputs are informational only and are not legal, financial, tax, or investment advice. You are responsible for verifying any information before acting on it.

4. Your account

You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. You must be of legal age to enter into a contract.

5. Acceptable use

You must not misuse the Service, including by (a) using it for unlawful purposes, fraud, or spam; (b) infringing intellectual property or other rights; (c) attempting to interfere with security, including by introducing malware, probing, or scraping; or (d) reverse engineering, reselling, or redistributing the Service or its outputs, or circumventing technical limits.

6. Intellectual property

We (and our licensors) own the Service and all related software, content, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your chosen plan.

7. Payments, subscriptions, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, and refund mechanics are governed by Paddle's Buyer Terms.

Subscriptions renew automatically at the then-current price until cancelled. You may cancel at any time; access continues through the end of the paid period.

9. Service availability

We do not guarantee that the Service will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the fees you paid us in the twelve (12) months preceding the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is not permitted by law.

11. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends and we may delete your account data after a reasonable period.

12. Governing law

These Terms are governed by the laws of the State of Alabama, USA, without regard to conflict-of-laws principles. Courts located in Alabama will have exclusive jurisdiction over any disputes, subject to any mandatory consumer protections available to you.

13. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
